Terms of service
The short version: you own your music, you pay for the work, I do the work properly, and we both stay honest. The long version is below.
1. Who you're working with
Perfect Driver Audio and Perfect Driver Music are run by Matthew Anthony Willems ("I", "me"), based in Nevada, USA. These terms cover this website and any audio services you book through it or by email ("the work"). By requesting an estimate or booking work, you agree to them.
2. Estimates and booking
Standard services have the starting prices shown on the site. Custom work (finish my track, create together, sound design, custom audio and anything else shown with a "usually" range) is priced in a written estimate after I've heard the project. Those ranges show what similar projects usually cost; they aren't quotes. A booking is confirmed when we've agreed on the scope, price and start date in writing (email counts) and the deposit has arrived. Prices are in USD and may change, but never on a job that's already confirmed.
3. Payment
Payment is 50% up front to book and 50% on completion (when the final files are ready). Projects under $100 are paid in full up front. You can also pay the full amount up front if you prefer. Pay by Zelle, Venmo or wire transfer. You pay any fees charged by your bank or payment provider. Demo feedback is paid in full up front; its $40 is credited toward finish my track or mix & master for the same track if booked within 30 days of delivery, once per track, with no cash value. Final files are released once the balance is paid. Late or missing balances pause the job.
4. Turnaround
Turnaround times on the site (for example "first version in 5–7 business days") are targets, not guarantees. Late files, missing stems or changes in scope move the timeline. Rush turnaround is available for an extra fee when my schedule allows.
5. Revisions
Every service includes 3 revisions. The first version I send is the first draft; each time you send notes and I send back a new version, that is one revision. Revisions mean adjustments to the agreed work. If you need more than 3, I may add a round at no charge or offer one for a small fee, and I will tell you before I start. New parts, a new arrangement or a new direction count as new work and get a separate estimate.
Review versions in your client portal are 320 kbps MP3 previews, for listening and notes only. High-resolution files (WAV, AIFF or the format I worked in) are delivered after final payment.
6. Cancellations and refunds
If you cancel before I start, your deposit is refunded minus any payment fees. Once work has started, the deposit covers time already spent and isn't refundable. If I can't finish the job for reasons on my side, you get back whatever you've paid for work not delivered.
7. Your material
You promise that you own or have permission to use everything you send me: stems, samples, vocals, loops, references and artwork. That includes clearing any samples. If someone makes a claim because material you supplied wasn't cleared, you're responsible for it, not me. Reference tracks are only used to guide the sound and are never copied into your work.
8. Who owns what
You keep all rights to your music. Once you've paid in full, the finished mixes, masters and edits I deliver are yours to release and sell. I keep the rights to my own tools, techniques, presets, templates and any sounds I made before or outside your project. For production work, credit, songwriting and publishing splits and ownership are set out in a short written agreement before the job starts. If there's no agreement, we'll sort it out in writing before release.
9. Confidentiality
Your unreleased music and project details stay private. I won't share, post or play your work, or name you as a client, without your written permission. That includes clips posted on this site. Production work stays confidential unless you want me credited.
10. What I can't promise
I promise careful, professional work. I can't promise commercial results such as label signings, plays, chart positions or streaming numbers. Coaching and 1-on-1 sessions are educational. How you use them is up to you.
11. Files and backups
Please keep your own backups. I keep project files for about two months after delivery so revisions stay easy, then delete them. The same goes for the review versions in your client portal. I'm not responsible for files lost after delivery.
12. Liability
To the extent the law allows, my total liability for any job is limited to the amount you paid for that job. I'm not liable for indirect losses such as lost profits or missed opportunities.
13. The website
This site and its content are provided "as is". The catalog, cover art and audio previews belong to Perfect Driver Music and its artists and licensors. Artist, DJ, plugin and brand names, and any software shown in screenshots, belong to their owners and are shown for reference only, with no endorsement implied. Links to other sites (Beatport, SoundCloud, social media) are covered by those sites' own terms. Don't use the booking form to send spam, malware or links to programs or installers. Those are blocked and deleted.
14. Law and disputes
These terms are governed by the laws of the State of Nevada, USA. If there's a problem, let's talk first. If we can't resolve it, disputes go to the courts of Washoe County, Nevada.
15. Changes
I'll update these terms when the services or the site change. The date at the top shows the latest version. A job that's already confirmed stays under the terms that applied when you booked it.
16. Your client portal
When we work together you can sign in at perfectdriveraudio.com/portal with a one-time link sent to your email. There you can follow your project, listen to each version, leave comments at exact moments in the track, approve estimates and versions, see invoices and payments, and leave me notes.
Your sign-in link is personal, so please don’t forward it. Approving an estimate in the portal counts as agreeing to it in writing, and the booking is confirmed when the deposit arrives (section 2). Approving a version means it’s finished as far as you’re concerned; changes after that count as new work. Comments and notes in the portal count as written messages. Review versions are for your ears only: please don’t share, upload or release them. Final files appear in the portal once the balance is paid.
The portal also keeps your messages with me, and any coupons or Perks discounts I give you. Coupons and Perks are for the client they were issued to and can’t be transferred. A Perks discount adds to a coupon or promotion only when that coupon or promotion says so, and a coupon and a promotion can’t be combined with each other. Both apply to projects of $100 or more, and I can change or end them for future projects. Finished projects of $100 or more count toward Perks levels, and so does your first finished project whatever it cost. The Perks discount only applies to projects of $100 or more. You can turn coupon emails off any time in Email settings.
